Terms & Conditions

  1. Accommodation will be provided by company.

  2. Medical facilities will be provided by company.

  3. Working hours shall be Nine ( 9 ) hours per day.( Including 1 hrs break )

  4. One day per week will be given a day off.

  5. Food providing by the Company.

  6. The period of contract will be two (2) years with probation period of three ( 3 ) months .

  7. Returned Air Ticket will be provided by the company at the end of contract period.

  8. Full cost of the employees resident permit shall be borne by the employer.

  9. All other terms and conditions of employment shall be in accordance with the Law and Regulations of the State of Qatar.

This agreement is made and entered in to between ……………………….., P.O Box …………… , Doha – Qatar . ( hereinafter called and referred to as foreign principal ) and Taridu Sampath D. , Manager of Winluck Enterprises No – 1135 / 1D , Boralle Road , Talawathugoda , Colombo – Sri lanka . License No – 2524 (hereinafter called and referred as local agent) for the recruitment of Sri Lankans for Qatar under the following terms and conditions.

  1. RECRUITMENT

  1. The reason of recruitment shall be for employment as per demand letter and shall be designated as stated in the letter of demand.



  1. DURATION OF CONTRACT .

  1. The duration of the contract initially shall be an open-ended contract with minimum 2 years renewable by mutual agreement.



  1. AIR PASSAGE .

  1. Free return air ticket should be provided for all employees after completion of contract by the foreign principal or the employer .



  1. WORKING HOURS .

  1. Working hours shall be Nine ( 9 ) hours per day , including ( 1 ) One hours break .

  2. Over time shall be paid for off duty hours and off days for working on such days

  3. One day off per week for all employees.



  1. RESPONSIBILITIES OF THE FOREING PRINCIPAL.

  1. The salary and other allowances shall be paid as per stated in the letter of demand and the letter of appointment.

  2. Free meal shall be provided .

  3. Free accommodation shall be provided .

  4. Free medical facilities shall be provided.( Gov Health Card )

  5. All complaints or complaint made by the employees and their elation regarding the employees and their working conditions shall be settled as soon as possible.

  6. The first party ( employer ) shall undertake the full cost of the second parties (employees )resident permit charges .



  1. RESPONSILILITIES OF THE LOCAL AGENT .

  1. The local agent shall select suitable candidate according to the foreign principals requirement and submit the relevant documents to the foreign principal .

  2. The local agent shall undertake to inform all candidates that they will be subjected to a period of 90 days considered as probation period .



  1. TERMS OF PAYMENT

  1. The foreign principal shall pay the sum of Qr Nil For selected employee as processing and administrative fees payable open final selection of employee.



  1. ANNUA LEAVE

  1. The employee or employees shall be entitled to 21 + 11 PH days paid leave on completion 1 year the flight ticket will be up-down at the second.



  1. IN CASE OF DATH .

  1. In the case of death of employee during the contract period , the foreign principal shall repatriate the remains along with the personnel effect and savings at the expense of the foreign principal .



  1. COMPENSATION

  1. foreign principal shall ensure that a personal life and accident insurance for the employee or employees to be provided for work related illness , injuries or death in accordance with the pertinent law of the country.



  1. OTHER TERMS AND CONDIITIONS

  1. All other terms and conditions of employment shall be governed by the pertinent law of the country .

  1. The attached Demand letter , Power of Attorney , Agency Agreement , Employment Contract Company Registration Certificate and all other documents submitted with job order approval application are part of this undertaking .



  1. Embassy of Sri Lanka shall be informed of the arrival of the employee within three month of his arrival .The notice should contain his profession, salary and status of residence permit .



  1. Embassy of sri lanka and its official can have access to the accommodation of the employees and office of the recruiting agent for the purpose of inspection at any time.



  1. The Salary of the employee shall be given during or at the end of every working month .The employee shall not be deprived of the salary and food allowance in case of employers failure of provides them with employment even for a short period.



  1. The employer /Agent in Qatar prepares the individual contract and submit the same to the sri lankan embassy for the approval along with the visa authorization . The contract should be prepared in compliance with the terms and conditions of the annex 1 to this undertaking .



  1. The Employer /Agent in Qatar should forward the approved contract to the employment agent in sri lanka who should proceed with the registration of the contract with the Sri Lankan bureau of foreign employment ( SLBFE ) .The Employment agent in sri lanka should give a photocopy of the same contract to the employee prior to departure for information



7 The Employer / Agent in Qatar should produce a copy of the same employment contract for

Authentication at the Ministry of Labour in Qatar as per the announcement made on 7/4/2009 under Labour low on (14 ) of 2004 , and no new contract is prepared at signed with the employee after his arrival in Qatar.

  1. The Employer/ Agent in Qatar should facilitate to obtain License / Trade certificate (Driving license or other permit ) which is required by the law of Qatar to carry out the duties under the employment contract . The total cost of this should be born by the employer and should not be deducted from salaries or any other dues from employee.




  1. It is the responsibility of the employer /Agent in Qatar to provide facilities to the employee to obtain such license. The employer shall not engaged the employee in duties until he gets the license and any fine or levy imposed by the Qatar authorities for non availability of the license while carrying on duties would be borne by the employer.



  1. The employer shall provide employee with time card for calculation of overtime and allowances.



  1. The Employer / Agent in Qatar will not relegate or downgrade the employee in terms of position , salary , benefits and work at any cost . The position /designation and category of the employee shall be decided only prior to the selection and recruitment.



  1. The employer shall bear the fees/cost of residence permit ,medical , electricity and water and accommodation . Employer shall also bear the fines if any , because of the delays in processing the above requirement.



  1. The employer shall make arrangement to repatriate the employee within one month after the completion of the contract with all his right except in case where mutually agreed to stay linger.



  1. Employer shall be responsible for the salary and other facilities of the employee even if the employee is supplied to other employer/s .



  1. In case of any misunderstanding / dispute between employer and employee the Embassy of sri lanka shall be contacted first for an amicable settlement of the grievances.



  1. All other terms and conditions not mentioned herein shall be subject to the legal provisions of the State of Qatar.
